Terms and Conditions

These Terms and Conditions apply to the use of the website scaleo-os.com and the platform at app.scaleo-os.com (together "Scaleo OS"), operated by Scaleo LLC, 8 The Green, Dover, DE 19901, United States ("Scaleo", "we", "us"). They apply to every visitor and user. Talents, companies and partners accept additional terms when they register. If those terms contradict these Terms and Conditions, the additional terms prevail for the matter they regulate.

1. What Scaleo OS is

Scaleo OS is a platform that connects international engineering talent, companies in Germany and the Netherlands, and mobility partners such as immigration law firms and relocation agencies. The platform calculates match scores, supports applications and the hiring process, and organises the mobility process after a hire.

Scaleo is not an employer, not a party to employment contracts between talents and companies, and not a legal, tax or immigration adviser. Partners act independently. Where a partner advises you on legal matters, the partner is responsible for that advice.

2. Accounts

  • You must be at least 18 years old and able to enter into contracts.

  • You may hold one account. It is not transferable.

  • Your information must be true and complete. Please keep it up to date.

  • Keep your sign-in details secret and tell us at once if you suspect misuse.

3. Restricted jurisdictions

We do not offer Scaleo OS to persons who are in, or resident in, Cuba, Iran, North Korea, Syria, or the Crimea, Luhansk and Donetsk regions. We check this at registration as described in our Privacy Policy. You must not use Scaleo OS if this applies to you.

4. Acceptable use

You must not:

  • provide false, misleading or third-party information in profiles, job postings or documents;

  • access accounts that are not yours, bypass access or security controls, scrape data or overload the platform;

  • publish discriminatory, abusive, harassing or unlawful content, including in job postings;

  • send spam, advertising or fraudulent messages;

  • ask for or use contact details of talents outside the stages released to you, or otherwise circumvent the platform (companies are bound by the circumvention rules of the Company Terms);

  • pass on profile data to third parties unless your terms or the talent's consent allow it;

  • use AI systems to infer sensitive characteristics of people from biometric data, or any other practice prohibited by EU law;

  • introduce malware or test for security vulnerabilities without our prior written consent.

We may remove content and suspend accounts for violations. We report indications of criminal offences to the authorities where the law allows or requires it. Report violations to info@scaleo-os.com.

5. Content and rights

Scaleo OS, its software, design and texts belong to Scaleo or its licensors. You receive a non-exclusive right to use the platform for its intended purpose while your account is active.

You keep the rights to the content you upload. You grant us the rights we need to store it and display it on the platform as set out in the Privacy Policy and your terms. You confirm that your content does not infringe the rights of others.

6. Visas, mobility and scores

  • Information on visas, residence permits and relocation is a general assessment based on public criteria, for example the EU Blue Card, the Skilled Worker route or the Highly Skilled Migrant route. It is not legal advice and does not replace individual advice.

  • Only the competent authority decides on a visa. Nothing on the platform is a promise.

  • The scores (Fit Score, Visa Eligibility, Mobility Readiness, Salary Alignment) are automated suggestions. They can contain errors. A person at the company makes every hiring decision.

  • We do not guarantee a hire, an offer, a visa or a specific salary.

7. Third-party content and services

Job postings and company information come from the companies. We do not check them in full and we are not responsible for their content. The platform may link to services of third parties. Their terms apply to those services.

8. Availability

We aim for high availability. Maintenance and faults can interrupt the platform. Deadlines with legal or official relevance do not run only through the platform, and we also inform you by email where this matters.

9. Liability

  • We are liable without limit for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and where we have given a guarantee.

  • For slightly negligent breach of an essential contractual obligation (an obligation on whose performance you can regularly rely), our liability is limited to the foreseeable damage typical for this kind of contract.

  • Otherwise we are not liable for slight negligence.

  • We are not liable for the content of job postings and information provided by companies, for decisions of authorities and companies, or for the services of independent partners, provided that we selected them with due care.

10. Suspension and termination

We may suspend or close an account if we reasonably suspect a violation of these terms or the law, or if we have another legitimate interest. We hear you beforehand where this is possible. You can delete your account at any time in your settings.

11. Changes

We may change these Terms and Conditions and the platform where this is reasonable for you. Material changes to the contract take effect only when you actively agree to them in the platform. We inform you in good time in text form. If you do not agree, you can delete your account. Changes that are legally required and do not disadvantage you take effect with notice.

12. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the country where you habitually reside remain unaffected. Consumers can bring claims before the courts of their place of residence.

13. Language and severability

The English version is authoritative. Translations are for convenience. If a provision is invalid, the rest stays valid and the statutory rule applies in its place.
